On the Chamber of Commerce’s business portal, there is a pilot scheme for the Web Module: Assessment of the Employment Relationship.
A quick look back in time
Specifically, the year 2016. On 1 May 2016, the Declaration of Employment Relationship (VAR) was abolished with the introduction of the DBA Act (Deregulation of the Assessment of Employment Relationships). This was accompanied by a one-year transition period. Clients and contractors had to determine together whether their relationship constituted an employment contract or whether the contractor was self-employed (ZZP).
It soon became apparent that none of this was working very well, and enforcement of the DBA Act was suspended. This is still the case, although the reins have since been tightened slightly.
The web module is intended to provide guidance to clients and contractors. During the pilot, the module’s output is, of course, not legally binding. Use of the module is also anonymous. The pilot will be used to assess whether it makes sense to introduce the module on a permanent basis.
For whom.
The pilot of the web module is intended for:
- clients based in the Netherlands;
- who outsource a contract to a contractor based in the Netherlands.
The pilot version of the web module is not intended for:
- clients acting as intermediaries or agents;
- contractors that are legal entities.
