It seems that a majority in the House of Representatives for the Fixed leases law is going to vote.
Main rule
After the introduction of the law, the main rule for letting independent living accommodation will be a lease for an indefinite period of time (permanent lease). Temporary letting is still possible only under specific conditions:
- re-occupancy by the landlord or previous tenant (intermediate tenancy/diplomacy clause);
- 5-year target group contracts, based on urgent own use, for specific categories (young people, students, PhD students, elderly and disabled people);
- rental by nature of short duration (e.g. holiday rental);
- to prevent vacancy;
- generic temporary letting of up to 5 years for non-self-contained housing.
In addition, the possibility for the landlord to invoke urgent own use will be extended. Urgent own use will also include providing housing to a first-degree relative of the owner by blood or marriage. The court must then weigh the interest of this relative by blood or marriage against that of the tenant to continue living in the rented property.
No transitional law
The new law will apply immediately to all new leases.
