Breakfast sessions
In October, in a number of well-attended breakfast sessions, we explained, among other things, the VBAR bill. VBAR stands for Verduidelijking Beoordeling Arbeidsrelatie en invoering Rechtsverm presumption. At the time, the Über judgment was already hanging over the market. In this judgment, the Supreme Court provided answers to (preliminary) questions raised by Hof Amsterdam on 21 February 2025. We describe this judgment in our article Entrepreneurship also counts when assessing self-employment.
In line with
Van Hijum indicates in the parliamentary letter that he will bring the bill VBAR Act in line with the Über judgment. This means that entrepreneurship will be fully included in the assessment of the employment relationship, Derhalve not, as in the original bill, only when the indications pointing to employeehood weigh as heavily as the indications pointing to self-employment.
The intention remains to have the VBAR Act come into force by 1 January 2026, but the minister noted that the timeframe for doing so would then be tight.
