Modernisation of child labour rules

There is a proposal for the modernisation of the Further Regulation on Child Labour (NRK) which is currently at the stage of internet consultation is. The proposed adjustments take into account the positive aspects of a side job and holiday work without compromising children's (working) conditions.

Current Situation

The Working Hours Act (ATW) prohibits work by children up to 16 years old, except under certain conditions for light work that does not pose a health hazard and does not interfere with education.

Proposed changes

1. More scope for work on non-school days and holidays

    • 13- and 14-year-olds may work until 8pm on non-school days and may work on Sundays.
    • 15-year-olds are allowed to work until 9pm on non-school weeks and conditionally on Sundays. On non-school days, they are now also allowed to work until 20:00.
    • Conditions: consent of the works council or employee representation and demonstrable consent of parents/carers. The Netherlands Labour Inspectorate can check this consent.

    2. Ban on working in hospitality industry for children under 16 years of age

    • Children aged 13 to 15 are not allowed to work in areas where alcoholic drinks can be served (this rule already exists under the Catering Act).
    • Excluded are work in other areas without contact with customers, such as washing dishes or helping in the kitchen.
    • This measure ensures better and more uniform enforcement by the Labour Inspectorate.

    Effects of the Changes

    • For 13-15-year-olds: more opportunities for side jobs and holiday work on non-school days and Sundays. Demonstrated permission from parents/carers is required.
    • For employers: additional administrative actions to record parental/carer consent, but more flexibility in staff scheduling.
    • Prohibition in hospitality venues: clarity and better enforcement of work rules for children, increasing safety.
