{"id":889,"date":"2020-02-28T12:09:26","date_gmt":"2020-02-28T11:09:26","guid":{"rendered":"https:\/\/vwg.nl\/uncategorized\/dagje-proefwerken-direct-een-arbeidsovereenkomst\/"},"modified":"2026-03-03T10:33:42","modified_gmt":"2026-03-03T09:33:42","slug":"a-day-of-tests-followed-straight-away-by-an-employment-contract","status":"publish","type":"post","link":"https:\/\/vwg.nl\/en\/dagje-proefwerken-direct-een-arbeidsovereenkomst\/","title":{"rendered":"A day of tests; an employment contract straight away?"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-7246\" src=\"https:\/\/vwg.nl\/wp-content\/uploads\/20191931_Inkomsten-toerekenen.jpg\" alt=\"\" width=\"1200\" height=\"628\" \/><\/p>\n<p>You may have a new employee in mind and want to let them \u2018try out\u2019 the job for a few days or \u2018shadow\u2019 someone for a day to get an initial impression before entering into an employment contract.<\/p>\n<h4>Tests\/work experience placements<\/h4>\n<p>If this \u2018trial period\u2019 \/ \u2018work experience\u2019 takes place without an employment contract having been concluded for this period, you, as an employer, run the risk that this period may be regarded as an initial employment contract. This is particularly the case if remuneration (other than an expense allowance) is paid.<\/p>\n<p>Incidentally, there is also case law which states that the \u2018trial period\u2019 or \u2018work experience\u2019 period may be classified as an employment contract even if no remuneration is paid. Furthermore, if a prospective employee spends a day \u2018shadowing\u2019, they are, in principle, not insured in the event that they sustain an injury on that day. Moreover, this work experience period cannot be classified as voluntary work, as strict conditions apply to such work (including that the work must be in the public interest or serve a specific social purpose, and that the work must be non-profit).<\/p>\n<h4>Statutory probationary period<\/h4>\n<p>The legislator\u2019s intention was to prevent potential employees from simply spending a day \u2018trying out the job\u2019 or \u2018shadowing\u2019 someone, whether or not they are paid for it; that is, after all, what the statutory probationary period is for.<\/p>\n<p>As an employer, you must therefore bear in mind that if you allow someone to \u2018work on a trial basis\u2019 or \u2018shadow\u2019 staff, an employment contract may well come into effect very quickly. This can lead to a situation where, if the employee is offered a fixed-term employment contract after the work experience period, this constitutes a second employment contract and the period during which the employee \u2018worked\u2019 prior to that also counts towards the probationary period.<\/p>\n<p>In total, you may enter into three fixed-term employment contracts with a maximum combined duration of three years. Allowing a probationary period can therefore mean that, from a legal perspective, the first fixed-term employment contract is actually already the second fixed-term employment contract. The resulting risk is that, if you as an employer assume you can still enter into a third fixed-term contract, it may in fact be deemed to be a contract of indefinite duration.<\/p>\n<p>You should therefore use the statutory probationary period as an opportunity to get to know the employee, and only allow them to start work once the employment contract has been signed.<\/p>\n<p>&nbsp;<\/p>","protected":false},"excerpt":{"rendered":"<p>Het kan voorkomen dat je een nieuwe werknemer op het oog hebt en deze enkele dagen wil laten \u2018proefwerken\u2019 of een dagje wil laten \u2018meelopen\u2019 om alvast een indruk te krijgen alvorens een arbeidsovereenkomst aan te gaan.
