{"id":868,"date":"2020-01-02T10:03:19","date_gmt":"2020-01-02T09:03:19","guid":{"rendered":"https:\/\/vwg.nl\/uncategorized\/meldplicht-buitenlandse-werknemers-in-nederland\/"},"modified":"2026-03-03T10:33:40","modified_gmt":"2026-03-03T09:33:40","slug":"obligation-to-register-foreign-workers-in-the-netherlands","status":"publish","type":"post","link":"https:\/\/vwg.nl\/en\/meldplicht-buitenlandse-werknemers-in-nederland\/","title":{"rendered":"Obligation to register foreign workers in the Netherlands"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-7101\" src=\"https:\/\/vwg.nl\/wp-content\/uploads\/20190821_Toeslagen.jpg\" alt=\"\" width=\"1200\" height=\"628\" \/><\/p>\n<p>With effect from <strong>1 March 2020<\/strong> Employers based in another EEA country or Switzerland must <a href=\"https:\/\/www.rijksoverheid.nl\/onderwerpen\/buitenlandse-werknemers\/meldingsplicht-buitenlandse-werknemers\" target=\"_blank\" rel=\"noopener noreferrer\">report<\/a> if they carry out work in the Netherlands with their staff.<\/p>\n<h4>EEA countries<\/h4>\n<p>This reporting obligation will be included in the <a href=\"https:\/\/wetten.overheid.nl\/BWBR0038054\/2018-01-01\/#HoofdstukIII_Artikel7\" target=\"_blank\" rel=\"noopener noreferrer\">WagwEU<\/a> and based on European legislation.<\/p>\n<p>The abbreviation EEA stands for the European Economic Area. This comprises all Member States of the European Union, Norway, Iceland and Liechtenstein. The reporting obligation also applies to employers from Switzerland.<\/p>\n<h4>Report<\/h4>\n<p>The notification must be submitted within 5 days via an online portal. A number of categories are exempt from the notification requirement:<\/p>\n<ul>\n<li>carrying out initial assembly or installation (for no more than 8 days);<\/li>\n<li>carrying out urgent maintenance or repairs and installing software (for a maximum of 12 consecutive weeks within a period of 36 weeks);<\/li>\n<li>business meetings (for a period of no more than 13 consecutive weeks in any 52-week period);<\/li>\n<li>activities such as attending scientific conferences;<\/li>\n<li>workers, such as researchers, international sportspeople and artists (subject to the relevant time limits).<\/li>\n<\/ul>\n<p>There is no exception for the transport sector.<\/p>\n<p>The Ministry of Social Affairs has produced a guide for foreign entrepreneurs <a href=\"https:\/\/www.postedworkers.nl\/online-melden\/documenten\/publicaties\/2019\/12\/14\/checklist-buitenlandse-werkgevers\" target=\"_blank\" rel=\"noopener noreferrer\">checklist<\/a> compiled.<\/p>\n<h4>Dutch entrepreneur<\/h4>\n<p>The Dutch business for which the service is provided must verify that the notification has been made.<\/p>\n<p>In addition, Dutch companies whose staff are going to work in another EEA Member State or Switzerland must report this to the relevant country.<\/p>\n<h4>Small employers<\/h4>\n<p>Employers with up to 9 employees are subject to a less stringent reporting requirement. These employers may submit an annual report.<\/p>\n<p>Small employers who submit an annual declaration may be based no more than 100 kilometres from the Dutch border and must work in the Netherlands on a regular basis. They must have carried out at least three shifts in the Netherlands during a calendar year.<\/p>\n<p>The option to submit an annual report does not apply to employers in the construction sector, employment agencies, temporary employment agencies and personnel management firms.<\/p>\n<h4>Self-employed people<\/h4>\n<p>In a number of sectors, self-employed people must also register if they are working (temporarily) in the Netherlands from another EEA country or Switzerland. This applies, amongst others, to agriculture, industry, construction, transport, catering and healthcare.<\/p>\n<p>Self-employed people have the option of submitting an annual declaration.<\/p>\n<p>Self-employed people can also make use of a <a href=\"https:\/\/www.postedworkers.nl\/online-melden\/documenten\/publicaties\/2019\/12\/14\/checklist-zelfstandigen\" target=\"_blank\" rel=\"noopener noreferrer\">checklist<\/a>.<\/p>","protected":false},"excerpt":{"rendered":"<p>Met ingang van 1 maart 2020 moeten in een ander EER-land of Zwitserland gevestigde werkgevers zich melden als ze met hun personeel in Nederland werkzaamheden verrichten.
