The rules of international tax law are often complex and vary from country to country. However, when it comes to property that does not form part of a company\u2019s assets (such as a holiday home abroad), the situation is not quite so complicated. This is because the \u2018situs\u2019 principle is generally accepted in such cases, and under this principle, property is taxed in the country where it is situated.<\/p>\n

Holiday home<\/h4>\n

Consequently, the holiday home in France owned by someone living in the Netherlands is (ultimately) not taxed in the Netherlands. The value of the property must, however, be included in the income tax return as part of the tax base for income from savings and investments (Box 3); but under the tax treaty, the Netherlands then grants a reduction for the income tax calculated on the foreign holiday home (deduction for tax paid elsewhere). This deduction is not granted automatically by the Tax and Customs Administration. A specific claim must be made for it in the income tax return.<\/p>\n

Net method<\/h4>\n

If the overseas property has been financed by a loan, the \u2018taxed elsewhere\u2019 deduction is granted on the balance between the value of the property and the loan. As early as 2006, the Supreme Court ruled that this net method must be applied in the case of a holiday home situated in France.<\/p>\n

Italy<\/h4>\n

In December 2015, the Amsterdam Court of Appeal reached the same conclusion in a case concerning a holiday home in Italy. Of particular relevance to the tax treaty with Italy was the fact that, according to the Court, a provision in the protocol did not apply to income tax. Under that provision, only debts secured by a mortgage must be offset when calculating the deduction for tax paid elsewhere.<\/p>","protected":false},"excerpt":{"rendered":"
