What you really need to know as an employer"},"content":{"rendered":"<p>Imagine using a smart system that sorts job applications for you. Or an AI tool that automatically assesses performance and predicts who is ready for promotion. Sounds efficient, right?<\/p>\n\n\n\n<p>But what if that system unknowingly discriminates? Or makes a wrong decision, for which you as an employer are responsible? This is exactly why there is now the <strong>AI Regulation<\/strong>&nbsp;- a new European law in force since August 2024. And it touches directly on the <strong>employment law<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why this concerns you<\/h2>\n\n\n\n<p>Most AI systems you deploy for HR purposes - such as selection, assessment or dismissal - fall under the category of <strong>\u2018high risk\u2019<\/strong>. And that means: extra rules and responsibilities.<\/p>\n\n\n\n<p>For example, you should:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Understanding how the AI system works and how the data is constructed.<\/li>\n\n\n\n<li>Informing employees if their performance or careers are affected via AI.<\/li>\n\n\n\n<li>Ensure human oversight - an AI decision should never be the sole voice.<\/li>\n\n\n\n<li>Be able to explain when someone is rejected or disadvantaged by the AI.<\/li>\n<\/ul>\n\n\n\n<p>Pretending to have \u201cjust used the system\u201d is no excuse. The AI regulation says: <strong>you remain responsible.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What are you risking?<\/h2>\n\n\n\n<p>If you don't manage this properly, you could end up in labour disputes with job applicants or employees - and risk fines of up to <strong>3% of your global annual turnover<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What can you do now?<\/h2>\n\n\n\n<p>Are you using third-party AI? Make sure you know and follow their instructions for use. Train your HR staff. Inform your OR or PVT - this is sometimes even mandatory. And be prepared for questions from employees about how the system works.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>AI offers opportunities, but it also changes your role as an employer.<\/strong><br>Make sure you know where you stand in time - legally and practically.<\/p>","protected":false},"excerpt":{"rendered":"<p>Stel je voor: je gebruikt een slim systeem dat sollicitaties voor je sorteert.
